<br />MEMO <br /> <br />DATE: <br /> <br />December 4,2001 <br /> <br />TO: <br /> <br />Planning and Zoning Commissioners <br /> <br />FROM: <br /> <br />Kim Moore-Sykes <br /> <br />~ <br /> <br />RE: <br /> <br />Zoning Map Modifications <br /> <br />......................................................................... <br /> <br />BACKGROUND <br />The Planning and Zoning Commission reviewed the proposed revised zoning map at the <br />November Planning and Zoning meeting. It was the Commission's recommendation to <br />continue the discussion to the next City Council meeting. The City Council is requesting <br />that the Planning and Zoning Commission provide them with a recommendation. <br /> <br />Between meetings, the Staff received a site plan for a proposed three-season porch <br />that would encroach into the C-I zoning designation. The property owner has submitted <br />the required variance requests to the Rice Creek Watershed District. The RCWD <br />proceeded with their process and determined that if the property owner obtained a <br />variance from the City of Centerville because the proposed three-season porch <br />encroaches on the floodplain, then they would be able to proceed with construction. The <br />RCWD found that the proposed three-season porch will not impact the flood plain <br />because it will be on stilts and is similar to other three-season porches in the immediate <br />area. It was further determined that RCWD does not recognize the City's C-l <br />designation but they do recognize the flood plain designation of the area and this is what <br />governs the initiation of their process. <br /> <br />In doing further research, Staff found that the C-l zoning designation was done <br />apparently to provide a recreational area around Clearwater Creek. I have provided a <br />copy of a rezoning request dated June 4, 1991 from the property owner at 1759 Main <br />Street whereby he states that the C-I (Parks and Playground) was intended to have a <br />walkway along the Creek. The Planning and Zoning Commission at the time allowed a <br />variance until such time as the area could be rezoned to R-2. <br /> <br />RECOMMENDATION <br />Staff is recommending that the Planning and Zoning Commission recommend approval <br />of the proposed Zoning Map modifications as proposed by Bonestroo, Rosene, Anderlik <br />& Associates. <br />
