<br />.' <br />, <br /> <br />February 15, 200l <br />Council Meeting Minutes <br />Council Member Nelson requested the modifications be made to the January 24, 2001 <br />meeting minutes: Page 4, where it indicates the type of exterior, building materials used <br />on the rear of the building should indicate siding not brick. Where it states Mayor <br />Swedberg requested Mr. Hoeft investigate the costs of electrical in LaMotte Park, it <br />should state Mr. Peterson. In the adjourmnent motion, the wrong Council Member was <br />inserted as the seconding member. Adjourned to the Executive Session, add a sentence <br />indicating the topic of discussion. <br /> <br />Motion bv Council Member Nelson, seconded bv Council Member Capra to <br />approve the Januarv 24, 2001 Council Minutes and the Januarv 31. 2001 Workshop <br />Meetin!! Minutes as amended. All in favor. Aves - 3 Navs - 0 Abstain - 2 <br />(Broussard Vickers and Travis). Motion carried. <br /> <br />VI. PETITIONS AND COMPLAINTS <br /> <br />I. Tom Wilharber Complaint <br /> <br />Mr. Tom Wilharber, 6849 Centerville Road, appeared before Council and questioned the <br />reasoning for re-scheduling the meeting, noticing same, whether the meeting was re- <br />scheduled to accommodate one (1) Council Member and whether Council felt they were <br />in violation of the open meeting law regarding the re-scheduling. Mr. Wilharber stated <br />that notice of the re-scheduling was not placed on the cable channel or in the Quad <br />Community Press, as has been the practice in the past. <br /> <br />Mr. March stated that he had received a telephone call requesting that the meeting date be <br />modified. Mr. March stated that he told the caller he did not feel comfortable with re- <br />scheduling the meeting unless he heard from a quorum of the Council Members. It had <br />been noted that Mayor Swedberg was out of town and had mentioned an interest in <br />having the date moved to Thursday. Mr. March stated that a third Council Member <br />contact him stating the re-scheduling the meeting was acceptable. Mr. March felt that <br />subsequent to receiving a quorum requesting the re-scheduling, notice was place in the <br />vestibule. Mr. March stated that a ten (10) day notice is not required; however, at least a <br />three (3) day notice is required. An emergency meeting may be called with one (1) day <br />notice. Mr. March stated that he was not sure of the exact date of the placement of the <br />notice on the cable channel, but it was more than three (3) days prior to the meeting. <br /> <br />Council Member Capra stated she had received an e-mail from Mr. March concerning the <br />re-scheduling of the meeting. <br /> <br />Mr. March stated after getting a quorum of calls he notified the other two (2) Council <br />Members bye-mail stating that the meeting would be re-scheduled. <br /> <br />Council Member Nelson stated she had called on the Monday of the week before the <br />scheduled meeting date and asked Mr. March if the meeting could be re-scheduled due to <br />conflicts with two (2) Council Member's schedules. Council Member Nelson stated that <br />due to same, she requested that Mr. March check with the other Members to ascertain if <br />the meeting. could .be re-scheduled. Council Member Nelson stated that she contact <br />Council Member Capra to ascertain if the re-scheduling was acceptable to her and it was. <br />Mr. March had e-mailed the other two (2) Council Members and Council Member Nelson <br /> <br />Page 2 of 18 <br />
