<br />. <br /> <br />3 Amended: 9/4/01 <br />2 Amended: 6/27/01 <br />1 Amended: 1/10/01 <br />Effective 9/5/00 <br />City of CentervilJe Ord. #4 <br />The common open space must be conveyed to the homeowners association or <br />similar organization subject to covenants to be approved by the City Council which <br />restrict the common open space to the uses specified on the final development plan, <br />and which provide for the maintenance of the con:rmon open space in a manner <br />which assures its continuing use for its intended purpose. <br /> <br />Section 180-280: Homeowners Association. If a homeowners association is <br />created, the applicant shall submit plans at the time offinal plan of development and <br />documents which explain: <br /> <br />A. Ownership and membership requirements; and <br /> <br />B. Articles of incorporation and bylaws; and <br /> <br />C. Time at which the developer turns the association over to the <br />homeowners; and <br /> <br />D. Approximate monthly or yearly association fee for homeowners; <br />and <br /> <br />E. Specific listing of items owned in common including such items <br />as roads, recreation facilities, parking common open space <br />ground, and utilities. <br /> <br />Division 185: Variances <br /> <br />Standards <br />The Planning Commission shall recommend a Variance and the Council shall order <br />the issuance of such Variance only if it conforms to the following standards: <br /> <br />A. Special conditions and circumstances exist which are peculiar <br />to the land, structure, or building involved and do not result from <br />the actions of the petitioner; and <br /> <br />B. Literal interpretation of the provisions of this Ordinance would <br />deprive the petitioner of rights commonly enjoyed by other <br />properties in the same district under the terms of this <br />Ordinance; and <br /> <br />C. Granting the Variance requested will not confer on the applicant <br /> <br />Page 68 of77 <br />
