<br />I- <br />I <br /> <br />Motion by Mayor Wilharber. seconded by Council Member Travis to fine the Trio Inn in <br />the amount of $300 and to forward the $300 to the Centennial Lakes Police Department to <br />assist efforts in curtailinl! underal!e liquor consumption. All in favor. Motion carried <br />unanimously. <br /> <br />IX. NEW BUSINESS <br /> <br />1. County Bank Variance Request <br /> <br />Council Member Trayis questioned whether Mr. Shannon, Color Sign, had researched <br />neighboring cities' ordinances to determine if their signs were in keeping with those ordinances. <br />Mr. Shannon indicated he had done so and submitted a report to Mr. March. <br /> <br />Motion by Council Member Travis. seconded bv Council Member Nelson to approve the <br />Countv Bank sil!n variance. All in favor. Motion carried unanimouslv. <br /> <br />2. Hasiak Variance Request <br /> <br />Council Member Sweeney questioned whether the recommendation of the Planning and Zoning <br />Commission was to allow the interior improvements to the building but to deny the exterior <br />expansion. Mr. March indicated that was correct. <br /> <br />Motion bv Council Member Sweenev. seconded by Council Member Nelson to approve the <br />Hasiak variance request allowin~ interior improvements to the non-conforminl! structure <br />and denyinl! exterior expansion improvements. The Hasiaks are required to obtain the <br />required inspections and buildinl! permits. All in favor. Motion carried unanimously. <br /> <br />3. Salazar Variance Request <br /> <br />Motion by Council Member Sweenev. seconded bv Mayor Wilharber to approve the Salazar <br />variance request to allow for the six (6) foot. wood. privacv fence and for the fence to remain <br />in the City ril!ht-of-wav provided Mr. Salazar sien a document acceptine full financial <br />responsibility for anv damaees or removal ofthe fence from the City ril!ht-of-way. <br /> <br />City Attorney Hoeft noted a stipulation should be added to the motion to provide that Mr. Salazar <br />sign a document accepting full financial responsibility for any costs incurred for damage to or <br />removal of the fence. Mr. Sweeney requested a sentence concerning that matter be added to his <br />motion. <br /> <br />Council Member Travis indicated he had driven by the residence and feels the cost to move the <br />fence would be minimal due to the fact there were only two (2) comer posts installed. He <br />indicated the sprinkler issue is merely moving a few sprinkler heads, which is relatively easy. <br /> <br />Mayor Wilharber indicated he did not feel the resident should incur additional costs to move the <br />fence when he was originally given misinformation by a representative of the City. Mayor <br />Wilharber stated that he believed the fence is not far enough into the City's road right-of-way to <br />cause any real issue and he is in favor of the variance. <br /> <br />Council Member Nelson stated that she sympathizes with the Salazars as they are trying to do the <br />right thing, but does not feel that the variance requirements have been met. <br /> <br />Page 9 of 14 <br />
