<br />r <br /> <br />Section 10 <br /> <br />LEGAL NON-CONFORMING SIGNS <br /> <br />Sec. 10.1. Legal Non-Conforming Signs <br />(a) Notification of Non-Conformity, After the enactment of this Code, the Administrator shal" <br />as soon as practicable, survey the Cily or signs which do not conform to the require- <br />ments of this Code. Upon determination that a sign is non-conforming, the Administrator <br />shall use reasonable efforts to so notify either personally or in writing the user or owner <br />of the property on which the sign is located of the following: (i) the sign's non-conformity; <br />and (ji) whether the sign is eligible for characterization either as legal non-conforming or <br />unlawful. Failing determination 01 the sign owner, user, or Owner of the property on which <br />the sign is located, the notice m3Y be affixed in a conspicuous place to the sign or to the <br />business premises with which the sign is associated. <br /> <br />(b) Signs Eligible for Characterization as "Legal Non-Conforming." Any sign located within the <br />city limits on the date of adoption of this Code, or iocated in an area annexed to the city <br />thereatter, which does not conform with the provisions of this Code, is eligible tar char- <br />acterization as a "legal non-conforming" sign and is permitted, provided it also meets <br />the tollowing requirements: <br />(1) The sign was covered by a sign permit or variance on the date of adoption of this Code <br />if One was required under applicable law; or <br />(2) if no sign permit was required under applicable law for the sign in question, the sign <br />was in aJl respects in compliance with applicable law on the date of adoption of this <br />Code, <br /> <br />(c) Loss of Legal Non-Conforming Status. A iegal non-conforming sign shall immediately iose <br />its legal non-conforming designation if; <br />(1) the sign is altered in any way in structure or copy (except for changeable copy signs <br />and normal maintenance), which tends to or makes the sign less in compliance with <br />the requirements of this Code than it was before the alteration; or <br />(2) the sign ;s relocated to a position making it less in compliance with the requirements <br />of this Code; or <br />(3) the sign is repiaced; or <br />(4) on the happening of anyone of (1), (2, Or (3) the sign shall be immediately brought <br />into compliance with this Code with a new permit secured therefor, or shall be re- <br />moved. <br /> <br />Sec, 10.2, Legal Non-Conforming Sign Maintenance and Repair <br />Nothing in this Section shall relieve the owner or user of a legal non-conforming sign or owner <br />of the property on which the legal non-conlorming sign is iocated trom the provisions of this <br />Code regarding safety, maintenance and repair of signs, contained in this Code, provided, how- <br />ever, that any repainting, cleaning and other normal maintenance or repair of the sign or sign <br />structure shali not modify the sign structure or copy in any way which makes it more non-con- <br />forming or the sign may lose its legal non-conforming status. <br /> <br />45 <br />
