No. 1507 <br />MUNICIPAL PLANNING--ZONING.-CLARlFYING TREATMENT OF LEGAL <br />NONCONFORMING USES <br /> <br />Ai'\[ ACT relating to municipal planning; zonL'lg; clarifying the treatment of legal nonconfonning <br />uses: amending Minnesota Statu.tes 2000, section 462.357, by adding a subdivision. <br /> <br />BElT ENACTED B'yTHE LEGISLATURE OF TIlE STATE OF MINNESOTA: <br /> <br />Section L .VJnnesota Statutes 2000, section 462.357, is amended by adding a subdivision to read: <br /> <br /><<MN 8T ~ 462.357>> <br /> <br /><<+Subd. le. +>> NONCONFORMlTIES. <<+Any nOllconformlty, including the lav,fulllse or <br />occupation of land or premises ex.lsting at the time of the adoption of an additional control under this <br />chapter, may be continued, including through repair or maintenance, but if the noncon{urmity or <br />occupancy is discontinued for a period of more than one year, or any l1<)/]collfonning die is destroyed <br />by fire or other peril to the elltent of greater than 50 percollt of its market value, any subsequent use <br />or occupancy of the land or premises shall be a conforming me OT occupancy. A municipality may by <br />ordinance impose upon nonconrornriti~ reasonable regulations to prevent and abate nuisances and tc< <br />protect the public health, welfare. or safety.
