<br />4. Non-structuring commercial, industrial and institutional areas, <br />including parking and vehicle maneuvering areas, storage areas, <br />setback areas, and yards <br /> <br />c. Special Requirements <br /> <br />1. All Uses <br />a. No structure, fill, deposit, obstruction, storage of materials or <br />equipment, shall be aIiowed that unduly affects the capacity of <br />the floodplain or measurably increases flood heights. <br />Consideration of the effects of a proposed use shall be based <br />upon the reasonable assumption that there will be an equal <br />degree of encroachment extending for a significant reach of both <br />sides of the stream. <br />b. Building permits issued on the basis of approved plans and <br />applications authorize only the use, arrangement and <br />construction set forth in such approved plans and applications. <br />Any other use shall be deemed in violation of this Ordinance, <br />and punishable by penalty provisions of Section 7.04. The <br />applicant shall be required to submit certification by a <br />registered professional engineer, registered architect, or <br />registered land surveyor that the finished fill and structural <br />elevations were accomplished in compliance with the provision <br />of this Ordinance and regulations of the State of Minnesota. <br /> <br />2. Fill <br />a. All applicants must show that any fill that they propose to <br />deposit in the floodplain must have some beneficial purpose <br />and the amount thereof must not exceed that necessary to <br />achieve the intended purpose, as demonstrated by a plan <br />submitted by the owner showing the uses to which the filled <br />land will be put and the final dimensions of the proposed fill or <br />other materials. <br />b. Such fill or other materials shall be protected against erosion by <br />rip-rap, vegetative cover, or bulkheading. <br /> <br />3. Storage of Material and Equipment <br />a. The storage of materials that are, in time of flooding, buoyant, <br />flammable, explosive, or could otherwise be injurious to human, <br />animal, or plant life is prohibited. Stored materials must be <br />adequately flood-proofed and in full compliance with applicable <br />Pollution Control Agency regulations. <br />b. Storage of other material or equipment may be allowed if not <br />subject to major damage by floods and firmly anchored to <br />prevent flotation or readily removable from the area within the <br />time available after flood warning. <br /> <br />I 4/1/00 DRAFT <br /> <br />30 <br />
