CARLSON & ASSOCIA rES <br /> <br />7671 Central Avenue * Fridley, MN 55432 * (763) 786-1218 Fax (763) 786-1219 <br /> <br />September 4,2001 <br /> <br />Mr. Tim Swedberg, <br />Mayor, City of Centerville <br />and Council Members <br />1880 Main Street <br />Centerville, MN 55038 <br /> <br />RE: Ordinance #4, Division 75, Subdivision 1 <br /> <br />Dear Me Mayor, <br /> <br />I would ask with this letter that you consider an amendment to Ordinance #4, Division 75, Final <br />Grading and Landscaping, Subdivision I: No occupancy permit shall be issued until the lot upon <br />which the structure is constructed is brought to finished grade as specified. <br /> <br />...-.!- believe this ordinance, as it is written, would prevent any new resident from occupying their new <br />'.-home during winter construction, from November through March, or possibly April of the <br />following year, for the following reasons: <br /> <br />The Development and Grading Plan submitted during the development process is a footprint for <br />drainage in the front yards, side yards, and rear property lines. The Development and Grading <br />Plan submitted during the development process can not be an exact footprint for drainage and <br />grading behind the home because the actuai plan or depth of the home has not been determined. <br />An example would be Hunters Crossing. Each building pad on the Development and Grading <br />Plan is 70' deep. The actual depth of the home varies, (See Exhibit A), width x depth. This, in <br />effect, can change the actual grade in the area of the walkout behind the home requiring the <br />builder to quote 6.2 (G) of my purchase agreement: <br /> <br />6.2 (G) Purchaser shall construct a single-family detached home on the Lot pursuant with the <br />Drainage, Grading and Development Plan, approved by the City of Centerville. The Grading and <br />Development Plan is a guide for the purchaser in the design ofthe individual building site. The <br />purchaser agrees that additional onsite work, retaining walls, additional footing depth, <br />repositioning garage location, regrading drainage swales and removal of excess fill may be <br />required of purchaser to align grades and maintain proper drainage with adjacent properties. <br /> <br />This would become extremely difficult, if not impossible, during winter frost conditions. The <br />finish grade is also determined by a layer of black dirt which also becomes impossible during <br />winter conditions <br />
