For the <br />purpose of Division 102. a fence shall not include naturally growing shrubs. trees or other <br />foliage. <br /> <br />Division 102: Fences <br />The purpose of Diy is ion 102: Fences is to promote a pleasant physical environment and <br />to protect the public and priyate property within the City by regulation the location, <br />height. tvpe of construction, and maintenance of all fences. <br />~<ltt"IL\l.'-"\' <br />AlI.fences. partitions. structure. wall or eate erected as a divider. barrier, or <br />enclosure and located alone the boundary or within any yard reQuire a fence permit <br />before installation or construction. The owner/contractor is responsible for locating the <br />property corner markers prior to applying for a fence llermit. Ifthe iron lot pins/markers <br />cannot be located, the applicant is to contact a land surveyor to re-establish the lot corners <br />before commencing with the installation or construction of a fence. This information is <br />required to apply for a fence permit. If a dispute arises oyer the placement ofthe <br />property markers, it is the responsibility of the property owners to resolye the dispute <br />through any legal means ayailable to them. Any substantial alterations will also reQuire <br />obtaining a fence permit from the City. <br /> <br />A. Construction and Maintenance. All fences, when constructed to enclose <br />any lot or tract ofland, shall be located entirely upon the property ofthe fence <br />owner. unless the owner ofthe adjoining property agrees, in writing, that said <br />fence may ee erected on the property line of the respective pf8perties. 800ft <br />an agreement shall ee sHbmitted at the time oflmilding permit application. If <br />the adjoining property 8wner does not agree to the erection of sHeh fence, the <br />fence shall be set back a minimmn OftY/O (2) f-cet from all lot lines. Posts and <br />framework shall be placed within the property lines of the owner and the <br />actual fencing material. such as wire, lumber. pickets, etc.. shall be placed on <br />the side of the fence which faces the street or adiacent property. <br /> <br />No fence other than a deeofative fence may be eonotructed along the side lot <br />lines of a resiaentiallot between the street and the front extension of the <br />dwelling hOHse. f.s Ilsed herein, the term "dee8rative fence" means a weed <br />vertical pest and ';/eOG herizental rail fonee with ne mere than three (3) rails <br />or a woed picket type f-cnee with at least tv:e (2) inches of epen space eetv:een <br />each picket. <br /> <br />All fences shall be constructed and maiFltained in a sllbstantial, workmanlike <br />manner and of substantial material reasonably suited for the purpose for which <br />the fence is to be used.
