<br />MASSAGE CERTIFICATE REQUIRED <br /> <br />No person shall perform massage services within the City without a massage certificate as provided in <br />this Ordinance. <br /> <br />CONTENTS OF APPLICATION FOR MASSAGE CERTIFICATE <br /> <br />An application for a massage certificate shall be made only on forms provided by the City. The <br />application shall contain the following information together with any other information the City may <br />require: <br /> <br />A. Evidence of the applicant's educational qualifications, including originals or certified <br />copies of degrees, diplomas or certificates, if any, including proof of receiving at least <br />100 hours of certified therapeutic massage training recognized and accepted by a state <br />or national professional therapeutic massage organization. <br /> <br />B. Evidence of applicant's practical qualifications to practice massage. <br /> <br />C. The names and addresses of two (2) persons, who may be referred to as to the <br />applicant's character. <br /> <br />D. Whether the applicant has ever been convicted of a crime or offense other than a traffic <br />offense and if so, information as to the time, place and nature of such crime or offense. <br /> <br />E. Evidence in the form of a current certificate from a licensed physician practicing in <br />Minnesota indicating (i) that within the past thirty (30) days the physician has examined <br />the applicant, and (ii) that such examination was for the purpose of determining whether <br />the applicant had any communicable disease and (iii) that as a result of such <br />examination he believes that applicant is not suffering from any communicable disease <br />which would disqualifY tbe applicant from engaging in the practice of massage. <br /> <br />CERTIFICATE FEE, CERTIFICATE INVESTIGATION AND CERTIFICATE YEAR <br /> <br />The investigation fee shall be determined by City Council on an annual basis through a fee schedule <br />resolution along with the annual certificate fee. The certificate year shall be the calendar year and a <br />certificate shall be valid for the remainder of the calendar year in which it is issued. The certificate fee <br />and fee for investigation for the certificate shall be paid when the application is filed. In the event that <br />the application is denied or that the certificate, once issued, is revoked, cancelled or surrendered, no <br />part of the annual certificate fee and investigation fee for the issuance of a certificate shall be returned <br />to the applicant unless by express action of the City Council. A separate certificate shall be obtained <br />each year. The certificate holder shall display the certificate in a prominent place in the licensed <br />premises at all times. A certificate permitting the holder thereof to practice massage is nontransferable. <br /> <br />INVESTIGATION OF APPLICATION <br /> <br />Certificate Applications shall be reviewed by the Police Department, which shall furnish written <br />recommendations to the City Clerk. Thereafter certificates shall be granted or denied by the City <br />Council subject to the provisions of this ordinance. The applicant may appeal to the City Council. <br /> <br />Page 5 of12 <br />
