Experiences of other cities <br />indicate that such businesses can facilitate the spread of <br />communicable diseases by virtue of the design and use of the <br />premises, thereby endangering not only the patrons of such <br />establishments but also the general public; <br /> <br />(d) Sexually-oriented businesses can cause or contribute <br />to public health problems by the presence of live <br />a,dult entertainment in conjunction with food and/or <br />orink on the same premises; <br /> <br />(e) A licensing and regulatory scheme as prescribed <br />herein can facilitate and aid in monitoring sexually-oriented <br />businesses for adverse secondary effects on the community; and <br /> <br />(f) The risk of criminal activity and/oJ:' public health <br />problems can be min1mized through a licensing and regulatory <br />scheme as prescribed herein. <br /> <br />Subd. 2 The provisions of this Section 355 have neither <br />the purpose nor effect of impOSing a limitation or restr1ction <br />on the content of any communicative materials, including <br />Adult-orienteo materials. Similarly, it is not the intent or <br />effect of this Section 355 to restrict or deny access by <br />adults to Adult-oriented materials protected by the First <br />Amendment, or to deny access by distributors and exhioitors of <br />adult-oriented enteJ:'tainment to their int"nded mark"t.
