<br />, <br /> <br />" <br /> <br />. <br /> <br />(9) Pigments. Pigments used in tattooing must be sterile and free from bacteria and noxious agents and <br />substances including mercury. The pigments used from stock solutions for each customer must be placed in <br />a single-service receptacle, and such receptacle and remaining solution must be discarded after use on each <br />customer in accordance with procedures approved by the Health Authority. <br /> <br />(10) Code Compliance. The facility must meet all relevant building codes and federal law related to <br />access. <br /> <br />(11) Influence of Alcohol and Drugs. It is unlawful to practice tattooing, body piercing, body branding <br />or body painting while under the influence of alcoholic beverages or illicit drugs. A customer may not be <br />tattooed, pierced, branded or painted while under the influence of alcoholic beverages or illicit drugs. <br /> <br />(12) Written Instructions. The operator must provide the person tattooed, pierced or branded with printed <br />instructions on the approved care of the skin during the healing process. <br /> <br />(13) Living Quarters. A place licensed as a tattoo, body piercing, body branding or body painting <br />establishment may not be used or occupied as living or sleeping quarters <br /> <br />(14) Hepatitis. A person to be tattooed, branded or pierced must be asked whether the person has had viral <br />hepatitis in the preceding six months. A person suspected of presently having viral hepatitis or having had <br />viral hepatitis within the preceding six months may not be tattooed, branded or pierced unless the person <br />has the written consent of a licensed physician. Sanctions for License Violations. <br /> <br />(1) The City Council may revoke the license or suspend the license for a violation of: <br />A. A provision of this Article or any other local law governing the same activity during the license <br />period; <br />B. Violation of any criminaUaw during the license period which adversely affects the ability of the <br />licensee to honestly, safety, or lawfully conduct a tattooing, body piercing, body branding or body <br />painting business; <br /> <br />(2) The City Council may revoke the license or suspend the license if the licensee submitted false <br />information or omitted material information in the licensing process.
