<br />4 Amended: <br />J Amended: 9/4/01 <br />2 Amended: 6/27/01 <br />1 Amended: 1/10/01 <br />Effective 9/5/00 <br />City ofCenterville Ord. #4 <br />Section 180-280: Homeowners Association. If a homeowners association is created, the applicant <br />shall submit plans at the time of final plan of development and documents which explain: <br /> <br />A. Ownership and membership requirements; and <br /> <br />B. Articles of incorporation and bylaws; and <br /> <br />C. Time at which the developer turns the association over to the homeowners; and <br /> <br />D. Approximate monthly or yearly association fee for homeowners; and <br /> <br />E. Specific listing of items owned in common including such items as roads, recreation <br />facilities, parking common open space ground, and utilities. <br /> <br />Division 185: Variances <br /> <br />Standards <br />The Planning Commission shall recommend a Variance and the Council shall order the issuance of such <br />Variance only if it conforms to the following standards: <br /> <br />A. Special conditions and circumstances exist which are peculiar to the land, structure, <br />or building involved and do not result from the actions of the petitioner; and <br /> <br />B. Literal interpretation of the provisions of this Ordinance would deprive the petitioner <br />of rights commonly enjoyed by other properties in the same district under the terms <br />of this Ordinance; and <br /> <br />C. Granting the Variance requested will not confer on the applicant any special <br />privilege that is denied by this Ordinance to other lands, structures, or buildings in <br />the same district; and <br /> <br />D. The proposed Variance will not impair an adequate supply of light and air to <br />adjacent property, or unreasonably diminish or impair established property values <br />within the surrounding area, or in any other respect impair the public health, safety, <br />or welfare of the residents of the city; and . <br /> <br />E. Any person filing a petition requesting a variance or an amendment of the Zoning <br />Ordinance rezoning property or changing regulations within any use district shall pay <br />a fee according to the Schedule established by resolution of the City Council. The <br />fee is payable at the time of filing a Petition and is not refundable. <br /> <br />. .ction 185-010: Board of Appeals and Adjustments. The Planning and Zoning Commission shall <br />act as the Board of Appeals and Adjustments and shall have the power to hear and recommend requests <br /> <br />Page 62 of 69 <br />
