Chair Hanson indicated that this matter would be on the June 25, 2003 Council agenda. 2. Ordinance #31 - Providing for Licensing and Bonding of Individuals. Firms. Corp.. Contractors and Subcontractors Chair Hanson opened the public hearing at 6:55 p.m. Ms. Moore-Sykes indicated that she had received a request from Council to place this on the agenda for public hearing and reconsideration of whether individuals should be licensed and bonded within the City for construction activities. Ms. Moore-Sykes indicated that an administrative fee of $25 would be charged annually to the contractors to provide the license. Commissioner Wilharber asked how this would be policed especially with all the building going on in Pheasant Marsh. He then said that the ordinance dates back to 1978 but, in 1978, there was not this much development going on at the same time. Ms. Moore-Sykes indicated that Staff could tell the contractors when they come in for a building permit that they need to be licensed by the City. Commissioner Wilharber indicated that there were some things that a permit is not required for. Ms. Moore-Sykes indicated that if you do one trade you are not required to have a license by the state of Minnesota. She then said that, if you are required by the state of Minnesota to have a license, then you are required to have a City license. Commissioner DeVine suggested listing the state licensing number on the building permit rather than requiring more stafftime and an additional fee. Council Liaison Broussard Vickers indicated that she saw one memo from one Council person about changing this. She then said that she does not think that $25 was enough to cover the staff time for this extra requirement. She further commented that she felt that it was the responsibility of the homeowner to research and determine whether the contractor they are hiring is reputable. Chair Hanson indicated that most respectable firms are licensed and insured and if a homeowner uses someone that is "fly-by-night" it is their responsibility. Commissioner De Vine indicated that he feels that the state is cutting funding to cities so the City should utilize the fact that they license contractors and use their information. Page 4 of 10
