<br />Memo... <br /> <br />TO: Ms. Moore-Sykes <br /> <br />FROM: Teresa Bender, City Clerk <br /> <br />SUBJECT: Hunters Crossing Re-Zone, Lot Combination & Preliminary Plat <br />Lloyd Drilling Re-Zone <br /> <br />DATE: May 6, 2003 <br /> <br />Due to the fact that the City's Comprehensive Plan shows that Mr. Carlson's property <br />that he desires to develop is currently represented as Agricultural and not slated for <br />MUSA development until 2006 & 2011, a Comprehensive Plan Amendment is needed. <br />Mr. Carlson is aware and has begun the process; however, two (2) Public Hearings are <br />needed for the amendment. No re-zoning action may be taken at this evenings Planning <br />and Zoning meeting or Wednesday's Council Meeting. Lot combination plays not part <br />and a recommendation may come forward to Council. Preliminary Plat may be <br />recommended for approval to come forward to Council contingent upon a <br />Comprehensive Plan Amendment and Re-Zone at Mr. Carlson's expense. Mr. Carlson <br />must sign a 60 day waiver otherwise Council has no alternative but to deny Mr. Carlson's <br />request due to the fact that the Comprehensive Plan prevails over the City Zoning Map <br />and same would not be allowable zoning. If desired, Mr. Carlson can submit a grading <br />plan for Engineer, Public Works Director and Council review and commence grading <br />upon proper permitting if he is willing to assume all costs associated with work <br />commenced and zoning or the Compo Plan Amendment is denied by either Met. Council <br />or City Council. <br /> <br />Due to the fact that the City's Comprehensive Plan shows that Mr. Lloyd Drilling's <br />property that he also desires to develop/re-zone is currently represented as Commercial, a <br />Comprehensive Plan Amendment is also needed. No re-zoning action may be taken at <br />this evenings Plarming and Zoning meeting or Wednesday's Council Meeting. Mr. <br />Drilling must sign a 60 day waiver otherwise Council has no alternative but to deny Mr. <br />Drilling's request due to the fact that the Comprehensive Plan prevails over the City <br />Zoning Map and same would not be allowable zoning. <br /> <br />Both public hearings may be held this evening at Planning and Zoning and again at <br />Council. However, if both waivers are signed Council may CONTINUE the re-zone <br />public hearings for June 11, 2003. I will place notices in the Quad for Compo Plan <br />Amendments for Public Hearings at May 28 & June 11, 2003 Council Meetings. At the <br />June 11, 2003 Public Hearing for the Compo Plan Amendments, the Re-Zone public <br />hearings will be reopened and acted upon. (I spoke with Lloyd, he is fine with the <br />process and will sign the waiver this evening, he will find you). <br /> <br />~ <br />
