The closest building was
projected to be located only 100 feet due south of the elevated tower. Maguire Iron and
Bonestroo have both contacted that developer, Paul Keleher, to inquire about the project status.
There is currently only one building on the site that has been completely constructed, and there
are two more buildings in various stages of construction. Paul Keleher has indicated that he
believes that the existing building will definitely be occupied prior to painting the tank. The
occupied building is located several hundred feet SE of the elevated tower. The two buildings
currently under construction are located closer to the elevated tower. His best guess for
occupancy of the building closest to the tower is most likely after June of 2005.

Based on this scenario, it would be possible to paint the tower without using a full containment
system as specified. We feel that the dollar amount offered for the deletion of the containment
system is fair. If the City desires to proceed with this change order deduct, we recommend that
the Change Order include language to ensure that the Contractor is still liable for any problems
associated with drifting sand and paint caused by the deletion of the containment system.
Additional] y, we would require the Contractor to use wind speed and direction as criteria for
acceptable sandblasting and painting conditions.

.
