<br />.................................................................................. <br /> <br />AGREEMENT <br /> <br />TIllS AGREEMENT ("Agreement") made effective this _ day of <br />by and between Julie Lindsay, a single person ("Landowner") and <br />CENTER VILLE, a Minnesota municipal corporation ("City"). <br /> <br />,2004, <br />the CITY OF <br /> <br />RECITALS <br /> <br />WHEREAS, Landowner is the fee owner of real property situated in the City of <br />Centerville, Anoka County, Minnesota, legally described as W 75 ft of Lots I & 2, Block 8, <br />Centerville, according to the plat thereof and on file with the office of register of deeds of Anoka <br />County, (the "Subject Property"). <br /> <br />WHEREAS, Landowner is served by a failed well on the Subject Property, and <br /> <br />WHEREAS, the City plans to serve the property with watermain to be constructed in <br />Sorel Street in approximately three years, and <br /> <br />WHEREAS, Landowner is willing to run a temporary water service line across City <br />property to Heritage Street and pay all the costs to provide service until a permanent watermain <br />extension serves the property. <br /> <br />WHEREAS, the City agrees to allow a temporary water service line to serve the <br />Property pursuant to the terms of this Agreement. <br /> <br />NOW THEREFORE, in consideration of the mutual promises and covenants herein <br />contained and other good and valuable consideration, the receipt of which is hereby <br />acknowledged, the parties agree as follows: <br /> <br />1. Recitals. The foregoing recitals and prefatory paragraphs are hereby incorporated <br />into the body of this Agreement as if they were fully set forth herein. <br /> <br />2. . Installation of Temporarv Utility Service Connections. Because the Subject <br />Property is currently not served by the City's water system, Landowner must install a Temporary <br /> <br />1 <br /> <br />5~ <br />
