<br />> <br /> <br />AMENDMENT TO THE <br /> <br />ACCLAIM BENEFITS <br />HIPAA BUSINESS ASSOCIATE ADDENDUM <br /> <br />This Amendment to the Acclaim Benefits HIPAA Business Associate Addendum (the <br />"Addendum") is made and entered into this 20th day of April, 2005, by and between on <br />behalf of and in its capacity as Plan Administrator of the Covered Entity ("CE") and <br />Acclaim Benefits ("ACCLAIM"). <br /> <br />WHEREAS, the CE and ACCLAIM have previously entered into a HIPAA <br />Business Associate Addendum; and <br /> <br />WHEREAS, Section 9 of the Addendum provides that the Addendum may be <br />amended at any time by the written consent of the parties; <br /> <br />NOW, THEREFORE, effective April 20, 2005, Section 2 of the Addendum has <br />been amended to include the following new subsection: <br /> <br />2.k. ACCLAIM will implement administrative, physical and technical <br />safeguards that reasonably and appropriately protect the confidentiality, <br />integrity, and availability of the electronic protected health information that <br />it creates, receives, maintains, or transmits on behalf of the covered entity <br />as required pursuant to 45 CFR Parts 160, 162, and 164.
