<br />Ordinance #79 - Construction Site Runoff Control Ordinance <br />City of Centerville <br /> <br />79.01 Intent. To promote the health, safety and general welfare of the citizens of <br />Centerville, Minnesota, by requiring stormwater management practices for construction <br />activity. <br /> <br />79.02 Statutory Authorization. This ordinance is adopted pursuant to Minnesota <br />Statutes Section (462.351 for cities and towns, 394.21 for counties having a population <br />of less than 300,000 according to the 1950 federal census) (1990). <br /> <br />79.03 Findings. The City ofCenterville hereby finds that untontrolled land <br />disturbing activity at construction sites are subject to soil erosion and other pollutants <br />which enter into receiving water bodies adversely affeCting the public health, safety and <br />general welfare by impacting water quality, (lI"eating nuisances, im.pairing other <br />beneficial uses of environmental resources and hindering the ability of the City of <br />Centerville to provide adequate water, sewage, flood control and other community <br />servtces. <br /> <br />79.04 PuJ:pose. The purpose of the ordinllnce isto promote, preserve and enhance <br />the natural resources .within tile. City of Cent~l1e and protect them from adverse <br />effects occasioned by Poorly sited development or incompatible activities by regulating <br />land disturbing activities that would have an adverse and potentially irreversible impact <br />on water quality and enviromnentl11ly sensitive land; by minimizing conflicts and <br />encouraging proper insta11atio~ and maintenance of best management practices (BMPs) <br />for land disturbing activities; a.nd by requiring detailed review standards and procedures <br />for land disturbing activities proposed for such areas, thereby achieving a balance <br />between development, fedevelopment, and protection of water quality and natural areas. <br /> <br />79.05 Definitions. For the purpose of this ordinance, the following terms, phrases, <br />words and their derivatives shall have the meaning stated below. When inconsistent <br />with the context, words used in the present tense include the future tense, words in the <br />plural number include the singular number, and words in the singular number include <br />the plural number. The word "shall" is always mandatory and not merely directive. <br /> <br />A A\)plicant. Any person who wishes to obtain a building permit, zoning or <br />subdivision approval. <br /> <br />B. Erosion and sediment control and water <br />quality management practices that are the most effective and practicable means <br />of controIling, preventing, and minimizing the degradation of surface water, <br />including construction-phasing, minimizing the length of time soil areas are <br />exposed, prohibitions, and other management practices published by state or <br />designated area-wide planning agencies. <br />
