Contractors and Suppliers <br />(1) No contractor, subcontractor, union or vendor engaged in any activity under this Agreement shall <br />discriminate in the sale of materials, equipment or labor on the basis of age, sex, sexual <br />orientation, marital status, race, creed, color, national origin, or the presence of any sensory, <br />mental, or phYSical handicap. Such practices include upgrading, demotion, recruiting, transfer, <br />layoff, termination, pay rate, and advertisementforemployment. (Executive Order 11246 as <br />amended.) <br /> <br />(2) Ail firms and organizations described above shall be required to submitto the Agency certificates <br />of compliance demonstrating that they have, in fact, complied with the foregoing provisions; <br />provided, that certificates of compliance shall not be required from firmS and organizations on <br />contracts andlor yearly sales of less than $10,000. <br /> <br />(3) To the greatest extent feasible, the Agency shall purchase supplies and services for activities <br />under this agreement from vendors and contractors whose businesses are located in the area <br />served by block grant funded activities or owned in substantial part by project area residents. <br />(Section 3, Housing and Community Development Act of 1968, as amended.) <br /> <br />F. Notice <br />(1) The AQencV shail include the provisions of the appropriate preced/nQ subsections A. B. C. D, <br />and E of this section in everv contract or purchase order for Qoods and services under this <br />AQreement and shall send to each labor union or representative of workers with which it has a <br />collective bargaining agreement or other contract or understanding a notice advising the said <br />labor union or worke~s representative of the commitments made in these subsections. <br /> <br />(2) In advertising for employees, goods or services for activities under this Agreement, the agency <br />shall utilize minority publications in addition to publications of general circulation. <br /> <br />5. LABOR STANDARDS <br />The Agency shall require that project construction contractors and subcontractors pay their laborers and <br />mechanics at wage rates in accordance with the Davis-Bacon Act, as amended (40 USC sections 327-333); <br />provided that this section shail not apply to rehabilitation of residential property designed for residential use <br />by fewer than eight families. <br /> <br />A copy of the current Davis-Bacon wage rate and HUD form 401 0 and 92010 (copies of which are attached <br />hereto) must be included in all construction bid specs and contracts over Two Thousand and nol1 00 Dollars <br />($2,000.00). <br /> <br />6. PROPERTY MANAGEMENT <br />A. The Agency agrees that any nonexpendable personal property, purchased wholly or in part with <br />agreement funds at a cost of Five Hundred and nol1 00 Dollars ($500,00) or more per item, is upon its <br />purchase or receipt the property of the County andlor federal government. Final ownership and <br />disposition of such property shall be determined under the provisions of the U.S. Office of <br />Management and Budget Circuiar No, A-102 or A-11 0 as appropriate, <br /> <br />- 8- <br />
