<br />.' <br /> <br />Exhibit E <br /> <br />BOARD OF COUNTY COMMISSIONERS <br />Anoka County, Minnesota <br />August 12, 1986 RESOLUTION NO. <br />Haas 5 tef fen <br /> <br />86-70 <br /> <br />DATE <br /> <br />OFFERED BY COMMISSIONER <br /> <br />COUNTY BOARD POLICY - <br />COMMUNITY DEVELOPMENT BLOCK GRAm PROGRAM INCOME <br />AMENDING RESOLUTION 8S-42 <br /> <br />WHEREAS, Title I of the Housing and Community Development Act of 1974 os <br />amended provides for 0 program of Community Development Block Grants; and, <br /> <br />WHEREAS, the Anoko County Board of Commissioners has been designated os on <br />"Urban County" by the Federal Housing and Urban Development Departnient and <br />consequently is eligible to porticip"ote in the National Community Development Block <br />Grant Program; and, <br /> <br />WHEREAS, the Anoka County Boord of Commissioners has dir:ected the <br />'preparation of Q plan under the Community Development "Slock Gra~t Program i.n <br />concert with the municipolities of Anoka County; and, <br /> <br />WHEREAS, . os 0 portion of said pion, municipalities os the sub-grantee of <br />Community Dev~lopment Block Gront funds may utilize said funds in various prcgram <br />forms to benefit low and moderate income persons, to aid in the prevention or <br />elimination of slums or blight or to meet other community development needs h~ing 0 <br />particular urgency because of threat to health and safety; andJ . <br /> <br />WHEREAS, "program income" means income eorned by the sub-grantee f rom the <br />g~ont supported adivity such O~ proceeds from the sale of reol or personaJ property, <br />interest eorned on escrow accounts, revolving rehobilitdtion accounts or lump sum <br />rehabilitation accounts, income from service fees, sole of commodities, usage or <br />rental fees, loan proceeds from rehabilitation or economic development looos, and <br />interest earned on revolving loons end proceeds from special assessments levied to <br />recO'Ier the cost of constructing a public works or facility to the extent that such cost <br />wa~ initially paid with the Community Development Block Grant funds; and, <br /> <br />WHEREAS, in accordance with Federal regulations, Anoka County os the <br />Community Development Block Grant recipient must receive 011 pr09ram incomeJ to <br />be used for an)' erigibCe Comml1flity Development Block Grant activity and the CoUnty <br />must expend revenues generated by program income before further drawdown requests <br />will be avthorized:' ' <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Anaka Cavn.ly Baard af <br />Commis,sioners does hereby establish as a matter of policy that: <br /> <br />I) All CDBG program income meeting the above definition, except payments to a <br />County-approved LDC revolving loan act;':ount, sholl be promptly forworded to <br />AnoktJ County. ' <br /> <br />2>" Each LOC which has a COBG revolving loon account for economic development <br />will retain loon r~yments within the account for continued USe for economic <br />development subject to all CDBG regulations, and that the County or the city <br />will execute on agreement with the LDC which will include: ' <br /> <br />0) Prohibition of conflict of .intereSf OS provided in HUD Regulation 24CFR <br />Part 570.611. <br /> <br />b) Compliance with Title VI of the Civil Rights A~t of 1964. <br /> <br />c) Requirement for the lDC to submit quartel"Jy reports to the Anoka County <br />Community Development Director regarding the use and results of <br />expenditure of funds from the revolving loon Qccount for so long os Anoka <br />County rem?ins on entitlement county. <br /> <br />cO Any other provisions 'required by Stafe or Federal low or regulation. <br /> <br />3) Anoka Cavnty has established as of May I, 1985, a revolvi~g loan account for <br />deposit of all economic development loan payments received by Anoka Covnty. <br /> <br />BE 'IT FURTHER RESOLVED that, 011 program income received by AnoklJ County <br />from activities funded in fotol or perf from c municipality's CD8G project will <br />increase that community's budget for eligible COBG activities and sholl therefore be <br />available to the community for future expenditure pursuant to the. Joint Cooperation <br />Agreement in effect at the time of expenditure. <br />
