<br />~ i " 'It <br /> <br />development anticipated in the foreseeable future; <br /> <br />(9) The relationship of the proposed use to the Comprehensive Plan and <br />Floodplain Management Program for the area; <br /> <br />(10) The safety of access to the property in times offlood for ordinary and <br />emergency vehicles; <br /> <br />(11) The expected heights, velocity, duration, rate of rise and sediment transport <br />of the floodwaters expected at the site; and <br /> <br />(12) Other factors which are relevant to the purposes of this chapter. <br /> <br />(F) Time for acting on application. The City shall act on an application in the <br />manner described above within 60 days from receiving dIe application, except where tlle <br />City is granted an extension of time in which to make the decision. <br /> <br />(0) Conditions attached to conditional use permits. Upon consideration oftlle <br />factors listed above and tlle purpose of this chapter, tlle City Council shall attach any <br />conditions to tlle granting of conditional use permits as it deems necessary to fulfill tlle <br />proposes of this chapter. These conditions may include but are not limited to the <br />following: <br /> <br />=c.. c~~_.=, ~. ,=,=c ~-=tl)~-Mooification ot waste"treatinenTarul'water suppl?faCilities;'~'~c ~~=, <br /> <br />-"--- --- <br />------- -------- ----- <br /> <br />(2) Limitations on period of use, occupancy and operation; <br /> <br />(3) Imposition of operational controls, sureties and deed restrictions; <br /> <br />(4) Requirements for construction of channel modifications, compensatory <br />storage, dikes, levees and other protective measures; and <br /> <br />(5) Flood-proofing measures, in accordance witll tlle Minnesota Building Code <br />and this chapter. The applicant shall submit a plan or document certified by a registered <br />professional engineer or architect that tlle flood-proofing measures are consistent with the <br />regulatory flood protection elevation and associated flood factors for tlle particular area. <br />(Ord. 33-A, passed 4-12-1989) <br /> <br />~ 155.58 NONCONFORMING USES AND NONCONFORMING STRUCTURES. <br /> <br />(A) A structure or tlle use of a structure or premises which was lawful before tlle <br />passage or amendment of this chapter but which is not in conformity witll tlle provisions <br />of this chapter may be continued subject to the following conditions: <br /> <br />(I) No use shall be expanded, changed, enlarged or altered in a way which <br />increases its nonconformity; <br /> <br />(2) Any alteration or addition to a nonconformmg structure or nonconforining <br />use which would result in increasing the flood damage potential of that structure or use <br />shall be protected to tlle regulatory flood protection elevation in accordance witll any of <br />tlle elevation, fill or flood-proofing techniques (such as FP-I through FP-4 flood-proofing <br />classifications) allowable in tlle Minnesota Building Code, except as further restricted this <br />section; and <br /> <br />19 <br />
