<br />Draft 2005-09-23 <br /> <br />ENCROACHMENT AGREEMENT <br />AGREEMENT ("Agreement") made this _ day of , by and <br />between the CITY OF CENTERVILLE, a Minnesota municipal corporation ("City"), and <br />("Landowner(s )"). <br />RECITALS <br />A. Landowners own in fee as joint tenants the real property situated in Goodhue <br />County, Minnesota, legally described as follows ("Subject Property"); <br />(Insert legal description) <br /> <br />B. Landowners' bridge (hereinafter "Structure") is located partially on the Subject <br /> <br /> <br />Property and partially within the City's easement. Landowners seek permission from the City to <br /> <br /> <br />encroach in the City's easement. <br />NOW, TIIEREFORE, IN CONSIDERATION OF TIIEIR MUTUAL COVENANTS, <br />THE PARTIES AGREE AS FOLLOWS; <br />1. The City hereby grants Landowners permission to encroach into the City's <br />easement to the extent indicated on the Certificate of Survey attached hereto as EXIllBIT "A". <br />2.
