<br />. <br /> <br />118.05 INSPECTIONS. <br /> <br />A) Purpose. The purpose of this section is to establish standards for a program of inspections <br />meant to improve and maintain the overall rental housing in the city. Housing inspections do not <br />indicate compliance with any inspectional program other than that of the city. Inspections are <br />made as a public service and do not constitute any representation, guarantee or warranty to any <br />person as to the conditions of the building inspected. The city does not assume any responsibility <br />or liability in connection with the inspection and issuance of the license required by this chapter. <br /> <br />B) Initial compliance inspection. Prior to issuance of a license to operate a rental dwelling <br />unit, the Compliance Official, together with the local Fire Marshal, shall inspect the premises for <br />compliance with this chapter. A record of the inspection, listing any built-in deficiencies which <br />are exempt from compliance, shall be kept on file at the City Hall. <br /> <br />C) Triannual compliance inspection. All rental dwelling units shall be reinspected for <br />compliance with this chapter a minimum of once every three years. <br /> <br />D) Complaints inspections. Inspections shall be made at any time upon receipt of a complaint <br />wherein the complainant leaves his or her name, address and telephone number. Inspections will <br />not be made based upon anonymous complaints. <br /> <br />E) Permission of the tenant shall be requested before a rental unit is entered. If the tenant <br />refuses to permit the inspector to enter, the inspector is authorized to obtain an administrative <br />search warrant before making the inspection. <br /> <br />118.06 ADMINISTRATION AND ENFORCEMENT. <br /> <br />A) Unfitfor human habitation. <br /> <br />I) Any rental dwelling or rental dwelling unit, which is damaged, decayed, <br />dilapidated, unsanitary, unsafe, vermin or rodent infested or which lacks provision for <br />basic illumination, ventilation or sanitary facilities to the extent that the defects create a <br />hazard to the health, safety or welfare of the occupants or of the public may be declared <br />unfit for human habitation. Whenever any rental dwelling or rental dwelling unit has been <br />deClared unfit for human habitation, the Compliance Official shall order same vacated <br />\vithin a reasonable time and shall post a placard on same indicating that it is unfit for <br />human habitation and any operating license previously issued for the dwelling shall be <br />revoked. <br /> <br />2) It shall be unlawful for the rental dwelling or rental dwelling unit to be used for <br />human habitation until the defective conditions have been corrected and written approval has <br />been issued by the Compliance Official. It shall be unlawful for any person to deface or remove <br />the declaration placard from any rental dwelling or rental dwelling unit. <br /> <br />B) Secure unfit and vacated dwellings. The owner of any rental dwelling or rental dwelling unit <br />which has been declared unfit for human habitation, or which is otherwise vacant for a period of <br />60 days or more, shall make same safe and secure so that it is not hazardous to the health, safety <br />and welfare of the public and does not constitute a public nuisance.
