<br />City of Centerville <br />Ordinance #13 (Liquor) <br />08/28/02 <br /> <br />C. Applicants are responsible to verify information on citations and <br />violations with the Chief of Police prior to October 30 and <br />submission to the city. <br /> <br />D. The Council shall place on the agenda each year at the first.~"O <br />scheduled Council meeting in November to review and hear <br />testimony by any interested individual or party conceming the' <br />renewal of liquor licenses. This process allows for appeal of a <br />denied license and the required approval from the state prior to the <br />December 31 license expiration date. <br /> <br />E. Approvals are contingent upon licensee proof of required payment <br />of insurances, property taxes, and city utility bills. <br /> <br />F. The application shall specifically describe the compact and <br />contiguous premises within which liquor may be dispensed and <br />consumed. Except as for otherwise provided for herein. <br /> <br />G. The Chief of Police is requested to provide Council by October 15 <br />each year, a. summary of officer calls and the nature of those calls <br />to'licensed establishments. The Chief of Police is also requested to <br />report a graphical depiction of alcohol related issues such as <br />citations and arrests for driving under the influence or alcohol <br />related infractions for the previous 3 year period. <br />H. The City Administrator shall verify all information prior to issuing a <br />license. ' <br /> <br />Section 14. Transfer of License. <br /> <br />No license issued under this ordinance may be transferred without the approval of the <br />Council. Any transfer of stock of a corporate licensee is deemed to be a transfer of the <br />license, and a transfer of stock without prior Council approval is a ground for revocation <br />of the license. An application to transfer a license shall be treated the same as an <br />application for a new license, and all of the provisions of this ordinance applying to <br />applications for a license shall apply. <br /> <br />Death of Licensee <br /> <br />In the event of the death of a person holding a license, the personal representative of <br />that person shall be allowed to continue to operate the business within the terms of the <br />license for a period not to exceed 180 days after the death of the licensee. <br /> <br />Section 15. Investiaation. <br /> <br />A. Preliminary background investigation. On an initial application for a <br />license, on an application for transfer of a license and, in the sound <br />discretion of the Council that it is in the public interest t6 do so, on <br />an application for renewal of a license, the city shall conduct a <br />preliminary background investigation of the applicant or it may <br /> <br />Page 90fl7 <br />
