<br />51.06. <br /> <br />52. <br /> <br />52.01. <br /> <br />52.02. <br /> <br />52.03. <br /> <br />52.04. <br /> <br />52.05. <br /> <br />City ofCenterville <br />Ordinance #8 <br />Effective 12/16/82 <br /> <br />the City will accept full responsibility from that point on. <br /> <br />BUILDING PERMITS. No building permit shall be issued for the <br />construction of any building, structure or improvements to the land or any lot <br />within a subdivision as defined herein which has been approved for platting, <br />until all requirements of this Ordinance and all provisions for street <br />construction and land improvement have been complied with in full. <br />Furthermore, no building permit will be issued for the construction of any <br />building structure on any lot within the City which does not abut on a publicly <br />dedicated in maintained street. <br /> <br />AMENDMENT. <br /> <br />IN GENERAL. This Ordinance may be amended by following the procedure <br />specified in this section. <br /> <br />INITIATION. An amendment may be initiated by the City Council or the <br />Planning Commission or by the petition of a resident to the City Council. An <br />amendment not initiated by the Planning Commission shall be referred to the <br />Commission for study and report, and the Council shall not act on the <br />amendment until it has received the recommendation of the Planning <br />Commission or until sixty (60) days have elapsed from the date of reference <br />of the amendment without a report by the Commission. <br /> <br />ACTION BY COMMISSION. Before any amendment is adopted, the <br />Planning Commission shall hold at least one (I) public hearing thereon after a <br />notice of the hearing has been published in the official newspaper at least ten <br />(J 0) days before the hearing. Following the hearing, the planning <br />Commission shall make a report of its findings and unless the amendment has <br />been initiated by the commission, and commission determines not to <br />recommend it to the Council, it shall file a copy with the City Clerk within <br />fourteen (J 4) days of the meeting at which the date of the hearing was set. <br />When the amendment to the Commission. Failure of the Planning <br />Commission so to report on an amendment not initiated by its, is deemed to be <br />approval by the Commission ofthe amendment. <br /> <br />COUNCIL ACTION. Upon the filing of such report, or upon the failure of <br />the Planning Commission to file such a report within the time prescribed by <br />Section 52.03 on an amendment proposed by petition or by the Council, the <br />City Council shall hold such public hearings as it deems advisable. After the <br />conclusion of the hearings, if any, the Council shall act upon the request <br />within forty-five (45) days to adopt the amendment or any part thereof in such <br />form as it deems advisable. <br /> <br />FEE. Any person filing a petition requesting an amendment to this Ordinance <br />shall pay a fee according to the schedule established by the City Council. The <br /> <br />Page 29 of 34 <br />
