<br />Effective: 12/8/99 <br />City ofCenterville Ord. #5 <br />B. Such notice shall be made by certified mail at the last known address of the owner(s). <br />C. In the event the actual identity of last known address of the owner(s) is not <br />reasonably known to the police department, notice may be made by publication. The <br />notice must be published at least once in the official newspaper of the city. <br />D. In the event the owner has actual knowledge that the police department has <br />possession of such firearm(s), no additional notice shall be required. <br />E. After propernotice, and upon the expiration of the 65-day period described herein, all <br />unclaimed firearm(s) shall be destroyed in a manner and under circumstances to be <br />determined by the Chief of Police. <br />F. No unclaimed firearm(s) shall be sold or otherwise used for any purpose. <br /> <br />5.06 Penalty. Any person who violated any provision of this Ordinance shall be guilty of a <br />misdemeanor and upon conviction thereof, shall be punished according to prevailing State Laws. <br /> <br />5.07 Validity. The validity of any section, clause or phrases( s) of this Ordinance shall not affect the <br />validity of any other part. <br /> <br />5.08 Restrictive Clause. Centerville Ordinance #5, hereby states that if Minnesota State Statutes <br />pertaining to the sections, clauses and phrases of the above stated Ordinance are more restrictive than <br />of the City of Centerville's Ordinance #5, the State of Minnesota Statutes shall apply. If the City of <br />Centerville's Ordinance is more restrictive than the Minnesota State Statutes, the above Ordinance <br />shall apply. <br /> <br />5.09 Repealer. On the effective date hereof, Centerville Ordinance #5 dated October 10, 1973 is <br />repealed. <br /> <br />5.10 Effective Date.
