<br />€a <br />f""~l. terville <br /> <br />'L<luNL,/i,.J /:,o,~ <br /> <br />STATE OF MINNESOTA <br />COUNTY OF ANOKA <br /> <br />CITY OF CENTERVILLE <br /> <br />ORDINANCE #57 <br /> <br />AN AMENDMENT TO ORDINANCE #57 AN ORDINANCE REQUIRING THE <br />INSTALLATION OF SUMP PUMPS AND REGULATING THE DISCHARGE OF <br />SURFACE WATERS, DRAINTILE INSTALLATION, PROHIBITING DISCHARGES <br />INTO TIlE SANITARY SEWER SYSTEM ON TO STREETS OR ADJOINING <br />PROPERTIES AND PROVIDING PENALTIES FOR VIOLATIONS <br /> <br />PLEASE TAKE NOTICE that the Centerville City Council held a public hearing to consider <br />the proposed amended/new language to Ordinance #57 on December 10, 2003 and motioned to <br />adopt same. The language that was amended/new in Ordinance #57 is as follows: <br /> <br />Replaced! Amended Language: <br /> <br />4. Every person owning improved real estate that discharges into the City's sanitary sewer <br />system shall allow the City of Centerville employee( s) to inspect the buildings to confirm <br />that there is no sump pump or other prohibited discharge into the sanitary sewer system. <br />Any person refusing to allow their property to be inspected shall immediately become <br />subject to the surcharge hereinafter provided for. Any property found to violate this <br />Section shall make the necessary changes to comply with this Section and such changes <br />shall be verified by City ofCenterville employee(s). <br />5. A surcharge of ($75.00) dollars per month is hereby imposed and shall be added to every <br />sewer billing mailed on and after January 1, 1994 to property owners who are not in <br />compliance with this Section. The surcharge shall be added every month, until the <br />property is in compliance. The imposition of such surcharge shall be added every month, <br />until the property is in compliance. The imposition of such surcharge shall in no way <br />limit the right of the City of Centerville to seek an injunction in District Court ordering <br />the property owner to disconnect the non-conforming connection to the sanitary sewer <br />system or from pursuing any other legal remedies available. <br /> <br />AmendedlNew Language: <br /> <br />4. Every person owning improved real estate shall allow the City of CenterviIle employee(s) <br />to inspect the buildings to confirm that there is no sump pump or other prohibited <br />discharge into the sanitary sewer system. Two (2) attempts will be made, in writing and <br />forwarded to the owner of the subject property via U.S. Postal Service through certified <br />mail to arrange an inspection. If no response is received subsequent to these attempts, it <br />will be deemed a refusal to allow the subject property to be inspected and deemed not in <br />compliance with Section 2 of this Ordinance. Any person refusing to allow their property <br />to be inspected shall immediately become subject to the surcharge hereinafter provided <br />for. Any property found to violate this Section shall make the necessary changes to <br />
