Centerville City Council Centerville City.Hall 1880 Main Street Centerville, MN 55038 ~'7f\~ May 30,1996 Dear City Council Members: Attached is a copy of the Cenificate of Survey for Block 5, Lots I and 2 of Peltier Lake Hills, dated October II, 1978 (attachment i). Please note that on the east end of the above lots there is a 33 ft. by 200 ft. strip of land which is shown to be part of the original right of way for Mill Road. Because of Clearwater Creek and the embankment the actual road ran to the east of this right of way. With the Acorn Creek Addition and the abatement and relocation of the actual Mill Road through this area, this 33 ft. by 200 ft. area continues to exist as city property as shown on tbe current plot (attachment 2). This area has presented some problems in that it is difficult for the property owners to control the public wandering through private property destroying trees, leaving refuse, and disturbing wildlife present in the area. It is difficult also for property owners on both sides of the area to determine their actual property boundaries. There is also the question of liability when small children are allowed to play in this area with no supervision, especially during spring flooding, and no one but the City or the Police has any control of this area. We feel that the City does not have the time and resources to spend dealing with the problems ofsuch a minor area and should consider vacating this area. We therefor petition the City ofCenterville to vacate this property in favor ofthe owoers of Lots 1 and 2 of Block 5 of Peltier Lake Hills, in equal portion. Respectfully, ~-/~ ,'" Theodore D.
