<br />Centervil/e City Council <br />Centerville City.Hall <br />1880 Main Street <br />Centervil/e, MN 55038 <br /> <br />~~\~ <br /> <br />May 30,1996 <br /> <br />Dear City Council Members: <br /> <br />Attached is a copy of the Certificate of Survey for Block 5, Lots I and 2 of Peltier Lake Hills, dated October <br />II, 1978 (attachment I). Please note that on the east end of the above lots there is a 33 ft. by 200 ft. strip of <br />land which is shown to he part of the original right of way for Mill Road. Because of Clearwater Creek and <br />the embankment the actual road ran to the east of this right of way. <br /> <br />With the Acorn Creek Addition and the abatement and relocation of the actual Mill Road through this area, <br />this 33ft. by 200 ft. area continues to exist as city property as shown on the current plot <br />(attachment 2). <br /> <br />This area has presented some problems in that it is difficult for the property owners to control the public <br />wandering through private property destroying trees, leaving refuse, and disturbing wildlife present in the <br />area. It is difficult also for property owners on both sides of the area to determine their actual property <br />boundaries. There is also the question of liability when small children are allowed to play in this area with no <br />supervision, especially during spring flooding, and no one but the City or the Police has any control ofthis <br />area. <br /> <br />We feel that the City does not have the time and resources to spend dealing with the problems of such a <br />minor area and should consider vacating this area. <br /> <br />We therefor petition the City ofCenterville to vacate this property in favor of the owners of Lots I and 2 of <br />Block 5 of Peltier Lake Hills, in equal portion. <br /> <br />Respectfully, <br /> <br />~L/~ <br /> <br />Theodore D.
