The <br />wetland fill area is not in a shore land, but the deminimis exemption has already been used for the original <br />subdivision of the Clearwater Creek development, thus the deminimis does not apply. Compensatory <br />mitigation/replacement is proposed by purchasing 0.04 acres of new wetland credit and 0.04 acres of <br />public value credit from an active wetland bank in an adjacent major watershed. <br /> <br />INITIAL COMMENTS/CONCERNS: <br />WCA rules require the applicant to consider replacement (in order) first onsite or in the same minor <br />watershed, then in the same major watershed, then in the same County, and then in an adjacent watershed <br />or County. The applicant should provide justification for purchasing credits in an adjacent watershed. <br />There are 3 private wetland banks in the same major watershed (20) according to the BWSR website. <br /> <br />The current proposed mitigation is "out-of-kind" replacement because it is not of the same wetland type <br />(wetland banking site has Type 3 wetland versus Type6/7 being impacted), is not in the same County, <br />and is not in the same major watershed. The out-of-kind replacement ratio is 2.25: I. <br />
