OPENING <br /> <br />A. Roll Call <br /> <br />II. PUBLIC HEARING (8) <br /> <br />A. Vacation of Property - A construction easement in the proximity of Shad <br />Avenue and Main Street (See enclosed maps) was created when Rehbein Estates was <br />developed. Apparently, the developer failed to dissolve the easement upon <br />completion of the development in 1989. Therefore, Joyce Stevens -Greene has <br />requested to vacate the construction easement. However, the City has been unable <br />to verify whom the construction easement bas been dedicated to. If the construction <br />easement was dedicated to another party then the City, their approval is required to <br />vacate the construction easement too. <br /> <br />In conjunction with the request, the city has a storm sewer line along the west <br />property line and a receptor on the south property line. The City should obtain a <br />drainage and utility easement on both sides of the property. <br /> <br />Ms. Stevens -Greene intent is to transfer the 30' X 110' corridor of property to <br />Hubert Olinger. The City should note the newly created parcel will be viewed as a <br />parcel independent of Olinger's property. However, a "reverse subdivision" will <br />cause the two parcels to become one which will avoid the new parcel to potentially <br />become tax forfeited property. <br /> <br />FOR THE COMMISSIONS CONSIDERA nON: <br />The Commission may consider approval contingent upon a "reverse subdivision," and the <br />City obtaining a 15' drainage and utility easement on the west and south property lines.
