B. The City Authorized Representative for purposes of administering this Agreement is Paul <br /> Palzer, Public Works Director, (651- 429 - 4750), 1880 Main Street, Centerville, MN 55038, <br /> 1 5. LIABILITY <br /> In connection with the performance of this Agreement, each party is responsible for its own acts <br /> and omissions and the results thereof to the extent authorized by law. The City's liability is <br /> governed by Minnesota Statutes chapter 466 and other applicable law, The State's liability is _ - -{ Deleted: , <br /> governed by Minnesota Statutes §3.736 and other applicable law. The City will promptly repair <br /> (or pay the State to repair) any damage to the State's facility and equipment caused by City <br /> personnel or equipment. The State assumes no responsibility for the City's salt and the City will <br /> bear the risk of loss by theft and forces of nature. <br /> 6. _ STATE AUDITS <br /> The parties books, records, documents, and accounting practices and procedures relevant to this <br /> Agreement are subject to examination by the State and the Legislative Auditor and State Auditor <br /> for a minimum of six years. <br /> 1 7. REMOVAL OF MATERIALS <br /> The City will remove any City-owned unused materials from the State's site no <br /> later than 30 calendar days after the expiration or termination of this Agreement. <br /> Any materials not removed by that date will, at the State's option, either (1) <br /> become the property of the State, or (2) be removed and disposed of by the State, <br /> and the City will reimburse the State for the costs of removing and disposing of <br /> such materials. <br /> [the remainder of this page has been intentionally left blank] <br />
