12 -09 -09 <br /> incompatible with the best interest of the City of Centerville, its taxpayers or in <br /> conflict with state or federal laws. <br /> 20.2 Conflicts of Interest <br /> No Employee having the power or duty to perform an official act or action may be <br /> directly or indirectly interested in any contract, transaction, or zoning decision of the <br /> City of Centerville except as provided for in the Minnesota State Statutes. <br /> Any Employee having an interest in any proposed legislative action of the City <br /> Council and who gives an opinion or recommendation to the Council, shall disclose <br /> on the record of the Council meeting the nature and extent of such an interest. <br /> No Employee may purchase personal property from the City except property that is <br /> no longer needed by the City under the following conditions: <br /> A) There is a reasonable public notice and the goods are sold through public <br /> auction; and <br /> 13) The property is sold by a sealed bid process and the Employee has the <br /> highest responsible bid. The Employee who buys the property must not be <br /> involved in the auction or sealed bid process. <br /> No Employee may accept any gift or gratuity in any size under circumstances in <br /> which it could be reasonably thought to influence him or her in the performance of <br /> his or her official duties or in which it appears to be a reward for any official action <br /> on his or her part. Gifts or gratuities which may be acceptable are as follows: <br /> A) Awards for meritorious civic service contribution; <br /> B) Unsolicited items of nominal value that are donated to and shared by the <br /> work group; <br /> C) Unsolicited advertising or promotional materials with a value of less than <br /> $5.00; <br /> D) Unsolicited items such as meals which may be provided during meetings, <br /> receptions, or other gatherings where the elected official or Employee is in <br /> attendance in his /her official capacity. <br /> 20.3 Nepotism <br /> General: Relatives of current City Employees and City Council members are not <br /> eligible for employment in job classification in which a conflict of interest may occur. <br /> Therefore, relatives will not be hired where: <br /> A) One relative would have the sole authority or practical power to supervise, <br /> appoint, remove, or discipline the other; <br /> Page 36 of 50 <br /> Adopted _, 2009 <br />
