MEMO <br /> Date: May 9, 1997 <br /> To: City Council <br /> From: Theresa Brenner <br /> Re: Barett property <br /> Bob Barett called me on Tuesday to say the family still wants the city to handle snow <br /> plowing of the driveway and mowing the grass until Mrs. Barett moves into the apartment. <br /> Because Mrs. Barett has chose not to retain her lifetime estate on the property, she would <br /> be living on city property. He said they would sign a wavier of liability to protect the city <br /> from being sued if Mrs. Barett was injured in a fall. They agree with everything else in the <br /> purchase offer. They would continue to maintain and insure the home. <br /> Greg Hellings said this could be handled in a separate agreement that states all the terms for <br /> Mrs. Barett to live on the property, including the wavier of liability. He will have a draft <br /> agreement ready by the council meeting for our review and discussion. The only change to <br /> the purchase offer would be to cross of item #4 on the addendum no. 1 and have both <br /> parties initial it. That indicates that she is not retaining a lifetime estate. <br /> I support these changes because it would be a temporary situation and because of the <br /> liability wavier. If the council is still not comfortable with this, another option may be to <br /> offer a token amount of money, perhaps $500, for the Baretts to hire these maintenance <br /> services. <br /> I am leaving for a short vacation (Arizona!) but will be back in time for the council <br /> meeting. <br />
