14. All front and side yards shall be sodded thirty (30) days after certificate of <br /> occupancy is issued, between the months of May 1 and October 1. Certificates issued <br /> between October 2 and April 30 shall be sodded before June 15. <br /> 15. Invalidation of any one or more of the provisions herein by judgement or <br /> Court Order shall not affect any of the other provisions, and these shall remain in full <br /> force and effect until the date of expiration. <br /> 16. Enforcement of the foregoing shall be proceeding at law or in equity against <br /> any person or persons violating or attempting to violate any covenant or provision <br /> herein, either to restrain violation or to recover damages by any party hereto or party <br /> claiming under them. <br /> 17. Review by Committee. The Architectural Control Committee (ACC) is <br /> composed of Marcel Eibensteiner and Michael Black of Royal Oaks Realty, Inc., or their <br /> assigns. The ACC is to approve all plans, in writing, for size, design, exterior colors and <br /> location prior to obtaining a building permit. From and after the completion of <br /> construction and sale of each lot, no building, fence, wall or other improvement of any <br /> kind shall be commenced, erected or maintained upon such lot, nor shall any exterior <br /> addition or change or alteration therein be made until the plans and specifications <br /> showing the nature, kind, shape, height, materials and location of the same shall have <br /> been submitted to and approved in writing, by the ACC, as to harmony, external design <br /> and location in relation to surrounding structures and topography. <br /> IN WITNESS WHEREOF, the parties hereto have caused these presents to be <br /> executed this day of January, 1997. <br /> ROYAL OAKS REALTY, INC. <br /> BY <br /> Marcel Eibensteiner, President <br /> -Page 3- <br />
