City Attorney Jim Hoeft recommended settling now before they take us to court, which in
turn will end up costing the City more.
kit•ui 1 1 1 MU'i11 :"1. 1 I II 1 1. p s
the claim. Seconded by Mari Nelson. All in favor. Motion carried.
CEDAR STREET PARK
Jim March explained that Mr. Dennis Shudy is looking to lease or purchase Cedar Street
Park for the purpose of building a storage building or possibly a concrete business. The
land is zoned industrial and is two (2) acres. Mr. March also noted there are two other
parties interested in purchasing the property.
Tom Wilharber added the City acquired the property through a tax forfeiture. Mr.
Wilharber felt the City would be better off selling the property and using the funds for
another park or for park equipment.
Mr. March mentioned he spoke with Todd Smith (Anoka County Assessor) regarding the
value of the property. Mr. Smith explained the value is basically what is owed for back
taxes on the property, which amounts to 15,000 - 20,000. He also added that if the city
sold this property, the county could want their portion.
Council Member Theresa Brenner felt it would be best to wait until we are sure of the
Union Contract and the new Public Works site before selling the property.
Council Member Dick Travis questioned if there were any plans for 21st Avenue.
Jim March stated Gerald Rehbein's vision is to expand 21st Avenue to Cedar Street. Mr.
March Jim also pointed out that if the City rezones the property, there may be an
assessment that the City would be responsible for.
Council Member Sweeney asked if we have paid for the land yet.
Mr. March commented that the City has not paid for the land, and a Restricted Park Deed
exists so the land can only be used for a park. He was going to look into it further and
obtain more information.
Mayor Wilharber questioned if we want to discuss leasing to Dennis Shudy.
Mr. March stated that since there is a restricted deed involved, we do not want to pay to
have it changed to an unrestricted deed if the City isn't going to do anything with it.
Mr. Sweeney mentioned it would be worth paying the back taxes of $15,000.00 to obtain
the land, which is worth around $100,000.00.
3
