MEMO <br /> DATE : March 4, 1999 <br /> TO : Honorable Mayor and Council <br /> FROM : Jim March <br /> RE : Proposed Addendum to Parkview Addition Development Contract <br /> I drafted the following proposed addendum after speaking to Jim Hoeft in regards to a problem <br /> that is occurring in the Parkview Addition. Mr. Rick Carlson ( Parkview Addition Developer) has <br /> restrictive covenants and specific requirements in his contracts with builders that require the <br /> builders to submit building plans for the architectural review of Rick Carlson prior to the plans <br /> being submitted to the City. The problem is that some of the builders are delivering the plans <br /> directly to City Hall without having Mr. Carlson review them first. Mr. Carlson has rejected <br /> several building plans that did not meet the value or size requirements that he wants to see in his <br /> development. <br /> Because this item was not specifically mentioned in the developer's agreement, we did not want <br /> the City to be exposed to any liability by holding up the issuance of building permits without just <br /> cause. The language in this addendum should resolve this matter and help the developer to <br /> maintain a high quality residential development. <br />
