MEMORANDUM <br /> DATE: April 8,1999 <br /> TO: Honorable Mayor and Council <br /> FROM: Ms. Ry -Chel Gaustad, CMC City Clerk <br /> RE: The Reallocation of Assessments <br /> The City assessed the properties along 20th Avenue for sewer and water improvements. At <br /> that time, the Council elected to allocate the cost to benefited properties according to <br /> square footage. One of Mr. Rehbein's 38 acre parcels was no exception, and thus assessed <br /> accordingly ($152,498.77). Mr. Coatney (owner of Terminal Transport) was in the process <br /> of purchasing the property and signed a purchase agreement when the assessment was <br /> placed on the property. In their signed agreement, Mr. Rehbein and Mr. Coatney agreed <br /> that Terminal Transport, Inc. would be responsible to pay their assessment respective to <br /> the footage purchased. The two men agreed that Mr. Coatney's assessment responsibility <br /> is $30,548.12, and this amount would be assessed to his property until the term date of year <br /> 2008. <br /> Mr. Rehbein also entered into a similar agreement with Royal Oaks Realty ($100,000) <br /> containing corresponding stiplutations regarding assessments. However, this practice is <br /> not usually exercised by Cities. Under the stated circumstances, Mr. Rehbein requests that <br /> the City authorize Staff to reallocate the assessment as noted. <br /> Mr. James Hoeft will be in attendance to further discuss this issue. <br />
