MEMORANDUM <br /> DATE: April 8, 1999 <br /> TO: Honorable Mayor and Council <br /> FROM: Ms. Ry -Chel Gaustad, CMC City Clerk <br /> RE: Rezone Request for 1764 Main Street <br /> The City received an application to rezone the above - mentioned property. Proper <br /> notification and publication were completed. The request was scheduled to be heard <br /> during the Tuesday, April 6, Planning Commission meeting. During that same day, the <br /> petitioner verbally rescinded the request. Due to the Land Use law, the city must reply to <br /> such a request within 60 days. Applications that are not approved or denied before the <br /> time limit expires are automatically approved. Therefore, since the applicant did not <br /> rescind this request in writing, it is my recommendation that the Council formally deny the <br /> request. The Planning Commission moved to recommend denial because the request is not <br /> conducive to the Centerville Comprehensive Plan. <br />
