Procedures for determining whether a dog or animal is potentially dangerous or <br /> dangerous to the.community are warranted. The procedures prescribed herein balance the <br /> interest in immediate public protection from potentially dangerous dogs and animals and <br /> dangerous dogs and animals with the reasonable due process rights of dog and animal <br /> owners. <br /> Subd. 3. Definitions. Por the purpose of this Section, the following words and <br /> terms shall have the following meanings. <br /> A. Animal - every non -human species of animal, both domestic and wild. <br /> B. Animal Control Officer - e person employed by or under contract with the City <br /> or a licensed peace officer who is responsible for animal control enforcement. <br /> C. Animal Shelter - any premises designed by or contracted with the City for the <br /> purpose of impounding and caring for all dogs or other animals found in violation of the <br /> Section. <br /> D. At -Large - an animal shall be at large when it is not under restraint as defined <br /> in this Section. <br /> E. Cat - a domesticated feline wholly of the species Felis domesticus, male or <br /> female, intact or neutered. <br /> P. Compendium of Animal Rabies Control ( "Compendium') - the Compendium <br /> of Animal Rabies Control prepared by the National Association of State Public Health <br /> Veterinarians and approved by the Minnesota Board of Animal Health. <br /> G. Cruelty - every act, omission, or neglect which causes or permits unnecessary <br /> or unjust pain, suffering, or death. <br /> H. Custodian - a person, firm, corporation, organization, or department <br /> possessing, harboring, keeping, having an interest In, or having care, custody or control of <br /> an animal, excluding veterinarians or kennel operators provided that the animals are kept <br /> only temporarily on the premises and are owned by others. <br /> -126 - <br /> Amended Section 10.10 Ord, 97-02 11-6-97 <br /> Publication: Quad 11.18-97 <br />
