• <br /> SECTION V <br /> POLICE EQUIPMENT, <br /> LAND AND BUILDINGS <br /> 5.1 A. Equipment. Each of the municipalities to this agreement has contributed to the <br /> District for its use and benefit the municipalities' existing police equipment. The <br /> Commission shall control the use of such contributed equipment. The ownership <br /> of such equipment shall be retained by the municipality donating same. All <br /> expenses relating to the maintenance and repair of such equipment shall be an <br /> operating expense of the District. <br /> 5.2 B. Land and Buildings. Each of the municipalities to this Agreement may provide <br /> building space to the police department. Such land and or building space shall be <br /> owned by the City and leased to the police District. Such lease is to be an <br /> operating cost of the District. Any lease requires the approval of all member <br /> cities. Existing leases shall continue. The Commission shall control use of the <br /> buildings and land. <br /> 5.3 Ownership. New and used equipment purchased by the District after the effective <br /> date of the original Joint Powers Agreement (1 -1 -2000) shall be owned by the <br /> District. The District Chief shall conduct an equipment inventory annually and <br /> present such information to each member municipality. <br /> 5.4 All equipment controlled by the District shall be used when needed within the <br /> boundaries of the District for the benefit of the member municipalities. They should not <br /> be used outside the District, except as follows: <br /> (a) In areas outside the District, when police emergencies may endanger life or <br /> property within the District. <br /> (b) When use is covered by contracts duly entered into by the District for police <br /> services or other services outside the District. <br /> (c) When necessary to fulfill mutual aid agreements duly entered into by the <br /> Commission. <br /> (d) In case of major emergency or disaster, when authorized by the Police Chief, <br /> or in his absence, the officer in charge.
