COUNTERPARTS <br /> This agreement may be executed in several counterparts and all so executed shall <br /> constitute one agreement, binding on all of the parties hereto notwithstanding that all of <br /> the parties are not signatory to the original or the same counterpart. <br /> SECTION XV <br /> AMENDMENT <br /> 15.1 Modification. This agreement sets forth all understandings between the parties <br /> respecting terms and conditions of the District. All prior agreements, <br /> understandings, representations whether consistent or inconsistent, verbal or <br /> written, concerning this agreement, are merged into and superseded by this written <br /> agreement. No modification or amendment of this agreement shall be binding on <br /> any municipality unless each municipality agrees in writing to the proposed <br /> change or amendment. <br /> 15.2 Submittal. Any municipality wishing to submit an amendment to the agreement <br /> shall do so by submitting a written proposal to the Commission at a regularly <br /> scheduled or special meeting. The Committee shall forward the proposed <br /> amendment, with a recommendation to each member municipality, within 90 days <br /> of receipt of the proposed amendment. <br /> 15.3 Response to Proposed Amendment. Each recipient municipality shall respond to <br /> proposed amendment within 60 days of receipt from the Committee. If no <br /> response is received, the amendment is demed to be rejected. <br /> 15.4 No Mutual agreement Should the municipalities not mutually agree to amend this <br /> agreement that decision shall not proceed to dispute resolution as out lined in <br /> section 10. <br /> IN WITNESS WHEREOF, the parties hereto have caused this instrument <br /> to be executed by their respective mayors and clerks, and their corporate seals to be <br /> affixed hereto, the day and year first above written, all by, authority of their respective <br /> City Councils. <br /> CITY OF CENTERVILLE <br /> 14 <br />
