May 12, 1998 <br /> To: Planning and Zoning Connnission <br /> Re: 7007 20th Ave. lot split <br /> Dear Chairperson Welk and Commission Members: <br /> I have researched the underlying requirements for Ordinance 33 -A and this ordinance <br /> mirrors state law in its requirements for buildings in the floodway and flood plain. It <br /> appears that the commission may be able to waive requirements to certain items in the <br /> ordinance but that state statute will be the controlling law on what can be done on this <br /> property. <br /> I will copy the City Attorney, Greg Hellings on this issue and ask if he has any additional <br /> input that has not been discussed. One option Mrs. Greene may want to consider is to <br /> apply for a Letter of Map Amendment from F.E.M.A. in an attempt to remove this parcel <br /> from the official floodway. This is an option she may want to pursue to permanently solve <br /> this issue if the building can be removed from the floodway. <br /> If the property remains in the floodway, the building could be utilized as a cold storage <br /> facility but could not be converted into an office or work shop. The new lot upon which <br /> the building is located would become an unbuildable lot and it may not be in the best <br /> interest of the city to a Trove this request. <br /> Paul .
