en <br /> MEMORANDUM <br /> DATE: June 9, 1999 <br /> TO: Mayor Tom Wilharber <br /> FROM: Ry -Chel Gaustad, CMC City Clerk <br /> RE: Centerville Elementary School Sign <br /> The Elementary School applied for a variance in April to install a sign within the 35' set <br /> back requirements. <br /> The Planning Commission addressed the issue during its May 4, 1999 meeting. It was the <br /> Commissions hope to allow the sign to be installed since a planned ordinance change would <br /> allow it. In addition, the Elementary School's sign would not be closer to Main Street than <br /> the Centerville City Hall sign. In the spirit of community, the Planning Commission stated <br /> that they would like to approve the variance request. <br /> It is my opinion that the four criteria established for variance could be approved based on <br /> the following: <br /> Special conditions and circumstances exist which are peculiar to the land, structure, <br /> or building involved and do not result from the actions of the petitioners: <br /> *The adjacent properties have trees and the foliage obstructs vision, which does not <br /> allow the sign to be noticed from Main Street. <br /> Literal interpretation of the provisions of the is ordinance would deprive the <br /> petitioner of rights commonly enjoyed by other properties in the same district under <br /> the terms of this ordinance; <br /> AND <br /> Granting the variance requested will not confer on the applicant any special <br /> privilege that is denied by this ordinance to other lands, structures, or buildings in <br /> the same districts; <br /> *The school may be deprived of the rights enjoyed by the City of Centerville by use <br />
