en
MEMORANDUM
DATE: June 9, 1999
TO: Mayor Tom Wilharber
FROM: Ry -Chel Gaustad, CMC City Clerk
RE: Centerville Elementary School Sign
The Elementary School applied for a variance in April to install a sign within the 35' set
back requirements.
The Planning Commission addressed the issue during its May 4, 1999 meeting. It was the
Commissions hope to allow the sign to be installed since a planned ordinance change would
allow it. In addition, the Elementary School's sign would not be closer to Main Street than
the Centerville City Hall sign. In the spirit of community, the Planning Commission stated
that they would like to approve the variance request.
It is my opinion that the four criteria established for variance could be approved based on
the following:
Special conditions and circumstances exist which are peculiar to the land, structure,
or building involved and do not result from the actions of the petitioners:
*The adjacent properties have trees and the foliage obstructs vision, which does not
allow the sign to be noticed from Main Street.
Literal interpretation of the provisions of the is ordinance would deprive the
petitioner of rights commonly enjoyed by other properties in the same district under
the terms of this ordinance;
AND
Granting the variance requested will not confer on the applicant any special
privilege that is denied by this ordinance to other lands, structures, or buildings in
the same districts;
*The school may be deprived of the rights enjoyed by the City of Centerville by use
