(2) Engaged in any attack on any person under circumstances which would <br /> indicate danger to personal safety; or <br /> (3) Exhibited unusually aggressive behavior, such as an attack on another <br /> animal; or <br /> (4) Bitten one (1) or more persons on two (2) or more occasions; or <br /> (5) Been found to be potentially dangerous and /or the owner has personal <br /> knowledge of the same animal aggressively biting, attacking, or endangering <br /> the safety of humans or domestic animals. <br /> Subd. 6 Potentially Dangerous. Potentially Dangerous shall mean any animal which meets <br /> the definition of potentially dangerous dog set forth in Minnesota Statues Section 347.50, <br /> any successor statute, and or any animal that has: <br /> (1) Bitten a human or a domestic animal on public or private property; or <br /> (2) When unprovoked, chased or approached a person upon the streets, <br /> sidewalks, or any public property in an apparent attitude of attack; or <br /> (3) Has engaged in unprovoked attacks causing injury or otherwise <br /> threatening the safety of humans or domestic animals. <br /> Subd. 7 Enclosure. Any structure, except a dwelling, designed to securely enclose and <br /> prevent an animal from escaping therefrom, and /or designed to provide the animal with <br /> shelter and protection from the weather. <br /> Subd. 8 Kennel - Commercial: Any structure or premises on which three (3) or <br /> more animals - domestic pets, of one type, over six (6) months of age are kept, owned, <br /> boarded, groomed, sheltered, protected, bred, or offered for sale or any other <br /> merchandising. Every kennel shall be enclosed or fenced in such a manner as to prevent <br /> the running at large or escape of the dogs confined therein. <br /> Subd. 9 Kennel - Private: Any structure or premises on which three (3) or more <br /> animals - domestic pets, of one type, over six (6) months of age are kept for private <br /> enjoyment and not for monetary gain. Every kennel shall be enclosed or fenced in such a <br /> manner as to prevent the running at large or escape of dogs confined therein. <br /> Subd. 10 Owner: Any person, firm, corporation, organization, or department, possessing, <br /> feeding, harboring, keeping, having an interest in, or having temporary or permanent <br /> custody or control of the animal. <br /> Animal Ordinance #24 - Updated 9/99 Page 3 of 23 <br />
