• <br /> Contract. Such olio shall be approved by the City Attorney and filed with the City <br /> P Y PP Y ty Y tY <br /> Clerk. A certificate showing that CONTRACTOR has in force and effect the aforesaid <br /> insurance covering both CONTRACTOR and the CITY shall be filed with the City Clerk <br /> within ten (10) days from the execution of the Contract, and yearly thereafter at least <br /> thirty (30) days prior to the date of expiration of said policy of insurance for each year of <br /> the Contract. All of the foregoing to be in a company licensed to do business in the State <br /> of Minnesota and acceptable to the CITY. Memorandum policy and receipt for the <br /> payment of premiums for at least one year in advance and on each renewal date be <br /> provided herein. CONTRACTOR understands and agrees once refuse is collected said <br /> refuse is the responsibility of the CONTRACTOR. CONTRACTOR shall hold harmless <br /> and indemnify the CITY for all claims, actions, damages and causes of action of any kind <br /> whatsoever, including attorneys fees. The hold harmless and indemnification includes all <br /> claims involving hazardous waste and materials classified as hazardous according to the <br /> CITY, County, State and Federal regulations. <br /> 18. WORKER'S COMPENSATION INSURANCE <br /> CONTRACTOR shall at all times keep fully insured, at its own expense, all persons <br /> employed by it in connection with the performance of this contract as required by the <br /> laws of the State of Minnesota relating to Worker's Compensation Insurance and shall <br /> hold the CITY free and hannless from all liability from any cause that may arise by <br /> reason of injuries to any employee of CONTRACTOR who may be injured while <br /> performing work or labor necessary to carry out the provisions of the Contract. <br /> 19, PERFORMANCE OF CONTRACT <br /> A. Supply Necessary Items <br /> CONTRACTOR shall supply all labor, materials, and equipment necessary for the <br /> carrying out of this contract. <br /> 13. No Claims <br /> CONTRACTOR further agrees to pay all persons doing work or furnishing skill, <br /> tools, machinery, materials, insurance premiums, equipment insurance, and <br /> supplies in and about the performance of this Contract. <br /> C. Indemnification. <br /> CONTRACTOR further agrees to take all precautions to protect the public against <br /> injury and to save the CITY harmless from all damages and claims of damages <br /> that may arise by reason of any negligence of CONTRACTOR'S or <br /> CONTRACTOR'S agents, or employees while engaged in the CITY against all <br /> claims, liens, expenses, and claims for lines of work, tools, machinery, materials, <br /> insurance premiums, equipment or supplies, and against all loss by reason of the <br /> 12 <br />
