application indicates that the dwellings, apartments, or rooming units offered for rent <br /> comply with all provisions of this code, including any provisions of the zoning, building, <br /> fire safety, or health ordinances.applicable in sections 32.03 and 32.05, the director of <br /> building and safety shall issue a registration certificate. Every registrant of a dwelling, <br /> apartment or rooming unit offered for rent shall post the registration certificate in a <br /> conspicuous place. <br /> 38.08 Notice of Violation. Whenever the investigation of an application for registration <br /> certificate indicates that the dwelling, apartment or rooming unit offered for rent does not <br /> comply with the provisions of this code, the director of building and safety shall serve a <br /> notice to the applicant, as specified in 32.11. Additionally, owners of rental property must <br /> give notice of outstanding violations under 38.153 of this chapter to purchasers of such <br /> property. <br /> 38.09 Rejection of Anplication. Whenever the investigation of an application for registration <br /> certificate indicates that the dwelling, apartment or rooming unit does not comply with the <br /> provisions of this code, and from the nature of the violations, the dwelling, apartment or <br /> rooming unit cannot be brought up to meet the minimum requirements, the director of <br /> building and safety shall return the application to the applicant stating the reasons for the <br /> rejection of the application. <br /> 38.10 Appeals. Any applicant whose application for registration certificate, after investigation <br /> has been rejected by the director of building and safety, may request and -shall be granted <br /> a hearing in the matter before the board under the procedures set forth in Chapter 33. <br /> 38.11 Failure to Register. <br /> Subdivision 1. Every person required to register a dwelling, apartment, or rooming unit offered <br /> for rent under the provisions of this chapter and who fails to do so shall be guilty <br /> of a violation of this code. Each day that a property is rented out without a valid <br /> rental registration certificate on file for that property is a separate violation. A <br /> violation of this section shall be a misdemeanor punishable by up to a $700 fine, 9- <br /> days in jail, or both. <br /> Subd. 2. Any person who rents out to another any type of unit to be used for human <br /> habitation without first making out an application for a housing registration <br /> certificate shall be assessed a $50 penalty fee. <br /> 38.12 Certificate Renewal and Non - transferability. <br /> Subdivision 1. All registration certificates shall expire one year after date of issuance and must be <br /> renewed annually. All information required by Section 38.04 of this chapter must <br /> be submitted at the time of renewal.
