REVISED October 1, 1999 <br /> JOINT POWERS POLICE DEPARTMENT CONTRACT <br /> CITIES OF CENTERVILLE CIRCLE PINES, AND LEXINGTON MINNESOTA <br /> This contract is entered into this day of <br /> 1999, by and between the City of Centerville, hereinafter referred <br /> to as "Centerville," and the City of Circle Pines, hereinafter referred to as "Circle Pines," <br /> and the City of Lexington hereinafter referred to as "Lexington ", all city corporations <br /> located in the State of Minnesota, County of Anoka. <br /> WHEREAS, Centerville, Circle Pines and Lexington desire to establish, <br /> equip and operate a joint powers police department to protect, safeguard and furnish <br /> police protection for their citizens pursuant to Minnesota Statutes Section 436.06, and <br /> WHEREAS, the parties hereto desire to establish a Board of Police <br /> Commissioners pursuant to the authority of Minnesota Statutes Section 436.06, Subd. 2, <br /> hereinafter referred to as the " Police Commission" to control and supervise the <br /> administration of the joint police department. <br /> NOW, THEREFORE, IT IS HEREBY AGREED as follows: <br /> SECTION I <br /> GENERAL PURPOSE <br /> It is the general purpose of the parties to this agreement to continue an organization to <br /> jointly and cooperatively provide police protection services including, but not limited to, <br /> crime prevention, response to police calls and patrolling. The area included within the <br /> District is the area contained within the corporate limits of the cities, which are <br /> participating parties to this Joint Powers Agreement, as adjusted in the future, whether by <br /> annexation or otherwise. <br /> SECTION IT <br /> TRI -CITY POLICE <br /> ORGANIZATION <br /> 2.1 Establishment. There is hereby established the "Tri-City Police Department" <br /> (hereinafter referred to as the "Department ") to be managed through a two (2) tier <br /> system. The management tiers will be broken out as follows: <br /> The Chief of Police is an appointed position. Appointment, contract and <br /> ratification require the approval of all member cities. In the event that the <br /> member cities are unable to agree on a person to fill the position of Chief of <br /> Police, the Police Commission by majority vote shall appoint an acting Chief of <br />
