ORDINANCE NUMBER 5 <br /> AN ORDINANCE TO PROTECT AND PRESERVE THE PUBLIC'S SAFETY BY <br /> REGULATING THE DISCHARGE OF FIRE ARMS WITHIN THE VILLAGE OF <br /> CENTERVILLE AND PROVIDING A PENALTY FOR VIOLATION THEREOF. <br /> THE VILLAGE COUNCIL OF CENTERVILLE, MINNESOTA DO ORDAIN AS <br /> FOLLOWS: <br /> SECTION 1: It shall be unlawful to shoot, fire off, discharge <br /> or explode any gun, pistol, revolver, or other <br /> firearm or device which ejects a projectile, upon <br /> or onto: <br /> Any road, street, avenue, sidewalk or other <br /> public place in this village. <br /> SECTION 2: It shall be unlawful to shoot, fire off, discharge <br /> or explode any single ball ammunition in the <br /> Village except upon ranges permitted by the <br /> Village Council. <br /> SECTION 3: It shall be unlawful to own or operate a rifle or <br /> shooting range in this Village unless a permit <br /> therefore be issued by the Village Council. The <br /> fee for such permit shall be $15.00 and said fee <br /> shall be paid to the Clerk prior to issuance <br /> thereof. <br /> SECTION 4: Nothing herein contained shall prohibit the use of <br /> firearms: <br /> a) by duly authorized policemen or law <br /> enforcement officers, <br /> b) by persons engaged in the lawful defense of <br /> person, persons, or property. <br /> SECTION 5: Any person, firm or corporation violating any <br /> provision of this ordinance shall be guilty of a <br /> misdemeanor and upon conviction thereof shall be <br /> punished by a fine not exceeding three hundred <br /> dollars ($300.00) or by imprisonment not to exceed <br /> ninety (90) days. <br /> SECTION 6: This ordinance shall be in effect from and after <br /> its passage and publication according to law. <br /> Passed by the Village Council this 10th day of October, 1973. <br /> WALTER PRACHER, MAYOR <br /> ATTEST: LU MARCELLO, CLERK <br />
